DinerOmob.com user agreement

These terms are an agreement between DinerOmob.com and you. Please read them. They apply to the terms of payment and submission of your electronic device(s). The terms also apply to using the website and/or registering an account with DinerOmob.com and any future DinerOmob.com.

1. Explaining the terms and conditions

The terms “we” or “us” refers to DinerOmob.com

The “customer” or “user” refers to anyone who has used/will use or has registered an account with DinerOmob.com

The “product” or “item” refers to anything sent to DinerOmob which is expected to be exchanged for cash or recycled by DinerOmob consultants.

If you do not agree to the terms and conditions as set out please do not use the Website. The terms and conditions may be amended or modified at any time without prior notice. If on review of our terms and conditions you feel you disagree with them then you can choose to discontinue the use of DinerOmob.com. Please be aware that any continuation of use will indicate full acceptance of the terms and conditions set out. It is the responsibility of the user to check the terms and conditions regularly on www.DinerOmob.com..

2. The Website – www.DinerOmob.com

The website is laid out and provided to enable users to sell or submit electronic devices for recycling in acceptance of the terms and conditions laid out. DinerOmob holds rights to alter or change any part of the website at anytime without giving prior notice and without liability to users.

A – Using the website

Visiting the website does not require registration however to be able to use all the services offered by DinerOmob.com you will need to register an account. When completing the forms to register an account it is vital and necessary that the information provided is correct and accurate as otherwise the account holder will find their orders null and void. All users must be aware that they must be over 18years of age to be legally capable of entering into contracts. Each account enables one person to be involved in transactions and it is the name on the account who will be liable for any transactions made, therefore it is vital that account information is not shared, if you feel that your account information has been compromised then you must contact info@dineromob.com

B – Use of Website and Materials

DinerOmob.com is provided to the User for individual use (unless registered as a company or organisation) and non-commercial use and it is solely for the purpose of carrying out individual transactions with the Website. Using the website for any other purpose other than to sell or recycle products with DinerOmob is prohibited and will be bought to our attention. We have not provided an exhaustive list of the prohibitations but we are outlining that any alteration to the property of DinerOmob (website, content, email, database, etc) will not be tolerated and further any association with DinerOmob without prior written consent is not allowed. Common sense and responsibility for appropriate use is the duty of the user. No user or viewer of the website will attempt to infilterate or intefer with the proper working of the website including security systems put in place.

It is a sever violatation of the Site Terms to attempt in any way to disrupt or interfere with the security of, or otherwise cause harm to, the Website.

Any permitted use of the Website does not extend to using the Website or Materials for any illegal purpose, or to transmit to or through the Website or to or through any service any illegal, harmful, threatening, defamatory, obscene, hateful, pornographic or other objectionable material of any kind, or to interfere with, abuse or otherwise violate the legal rights of any third party using the Website or Materials.

Without limiting other remedies, we may limit, suspend, or terminate our service and user accounts, prohibit access to our website, remove hosted content, and take technical and legal steps to keep users off the Sites if we think that they are creating problems, possible legal liabilities, or acting inconsistently with the letter or spirit of our policies. We also reserve the right to cancel unconfirmed accounts.

DinerOmob grants permission to Users to provide links to the homepage of DinerOmob provided (a) you do not remove or obscure, by framing or otherwise, any portion of the homepage, (b) you discontinue providing links to this Website if requested by DinerOmob. Any positive promotion of services prvided by DinerOmob are to be broadcasted please send an email to info@dinerOmob.com to notify DinerOmob.

We appreciate users who choose to raise awareness by creating fundraising pages. Each fundraiser creating and designing a Page hereby represents that they own or have been authorised to use any and all content placed on the Page. Each fundraiser acknowledges that DinerOmob reserves the right to remove any Page or selected material from a Page if DinerOmob determines or is notified that any content placed on a Page is in violation of this representation.

DinerOmob.com is owned and operated as an individual entity and is not endorsed, sponsored by or affiliated with any companies mentioned on the website, unless otherwise mentioned. All content or advertisement text, photographs, designs, graphics, images, sound and video recordings, animation and other materials and effects (known as the "Content") are protected by copyrights, trademarks, service marks, trade dress, patents or other intellectual or proprietary rights owned by DinerOmob or other third parties. All brands, copyrights, logos, likenesses and registered trademarks are property of their respective companies or organisations. Any User or viewer of the website (“You”) may not remove from any electronic or printed copy any copyright, trademark, or other proprietary notice.


4. Privacy statement/information

DinerOmob.com recognises that privacy is very important. We will never share any of your personal information with any third party (unless it is in reference of security risk or on suspicion of illegal motives). All personal information submitted to DinerOmob.com will be used only by DinerOmob.com (unless for reasons stated above). When submitting information such as your name, email address, address, phone number and PayPal ID, the only purpose and use will be for conducting business with DinerOmob.com. 5. Pricing subject to change

Most issues are easily diagnosable and you will usually be paid for what you submit to us. Certain issues with your electronic device may not be apparent at the time of submission, but we will find them (this usually occurs about 10% of the time). We have dealt with thousands of electronic devices and are able to accurately diagnose and evaluate products. The most common mistake in submitting an electronic device is an incorrect generation or model. (For example, an iPod Nano Generation 2 versus an iPod Nano Generation 4.) In this case, we will adjust the price to reflect the difference in description and notify you if there is a significant price change. If you are unsure of what type of electronic device you have please email us to avoid price change after dispatch.

A. All Pricing Subject to Change - If there is a difference in the condition, type and amount of damage to your electronic device, the price is subject to change. If we determine that the electronic device is in a condition different from the submitted condition, we will adjust the price to reflect the condition. DinerOmob.com reserves the rights to make the final judgment of the condition of all electronics we test. We will also inform you via email if your pricing changes more than 25%. If the price change does not exceed 25%, we will process orders according to the terms and conditions set forth on DinerOmob.com.

B. Multiple Item Orders - In order to reduce the amount of materials being used and to be as cost-effective as possible, any order with multiple items must be packaged in one box. If you are unable to fit all of your items in one box, please do not create a new order. Instead, please generate your original label again and attach it to a bigger box. Any order that uses more than two boxes will have the cost of every additional box deducted from their payout.

C. Extreme Damage - Most extreme damage is included in this pricing; certain damage though is outside of this pricing. We will adjust the price to reflect any damage that is beyond the scope of pricing.

D. Opened, Tampered with, or Modified Electronic Device - Some of the time minimal external and internal damage is done to the electronic device, but most times there is severe external and internal damage. If we receive an electronic device that has clear signs of being opened and/or there is internal damage to the electronic device that was clearly done by a human, we will adjust the price. The adjustment can be anywhere from 0% to 100% less than the quoted price and is subject to our analysis, review and determination. For example, when an electronic device is submitted as "Dead" and we determine that the electronic device has signs of being opened, we will open the electronic device and find parts missing and/or wires cut, the price will be adjusted. Frankly, if you opened your electronic device, raided it for parts or tampered with it internally, we will know. Please be as honest as possible when submitting your item(s). To be sure of pricing please let us know what’s going on before you send us an electronic device that has been opened.

E. IT Passwords - BlackBerry Specific IT Policies: IT policies are normally put in place by a company through its BlackBerry Enterprise Server. These policies restrict any certain number of features on a BlackBerry (such as passwords, email settings, etc.), and CANNOT be removed with a full format of the device. The easiest way to identify if you have an IT Policy on your BlackBerry is go to Menu>Settings>Options>Security Options>Firewall, if there is a red lock next somewhere in the upper right quadrant of the screen, you have an IT Policy. IT passwords must be cleared from an item before they are sent to our facility. If you do not know how to remove the IT password from your item, please speak with an IT representative from your company.

F. Battery Life (for items with internal Batteries or Power Supplies - Your electronic device may be working perfectly but the battery may no longer hold a charge. If we determine during our diagnosis of your electronic device that the battery lasts for less than one hour, we will have to adjust the price we pay you to reflect a depleted battery.

G. Donating an item – it is in agreement that you must evaluate a product as precisely as possible and you understand that by donating a product for recycling it will not be retrievable at a later date, further you are consenting to the use of such item in any way deemed suitable by future buyers.

H. General Statement– You agree that DinerOmob agents will give you a fair price for the product they receive and if there is any dispute with regards to the price offered if not resolved by consultation will require the product being sent back to the seller in this case the cost of transit will be levy on the seller and DinerOmob will require reimbursement.

6. PAYMENT PERIOD. Electronic devices are paid for via PayPal or cheque in about a week of your item arriving to our facility. The testing process typically will take two days; larger orders may take longer. You can always contact info@dineromob.comfor an update on your transaction status.

A. Transit Times - Sometimes the shipping company may receive the electronic device but will not always deliver them to our office promptly, thus delaying receipt of your electronic device, which can delay payment. Most mail takes about 5 business days or less to reach our offices. For your own piece of mind we suggest you arrange a pick up with us or are able to track your orders.

B. Re-pricing and Feedback - If there is a difference between how the electronic device was submitted and the actual condition found by DinerOmob.com, the payment will be delayed because of additional testing. Additionally, if your item does not match up with your submission any time needed for feedback will delay the payment process. You may expect a delay of up to three to eight business days in this scenario. Shipping costs are covered up to and no more than £12

C. Electronic Serial Number Checks - We check the seal numbers of any products submitted which we find suspicious and this will in turn delay the process. If you are submitting brand new items please attach a short description of why the product is being sold.

D. Large Orders - Any order that contains 20 items or more, or is valued at £1000.00 or more is subject to an additional two to three business days to process and send payment.

E. Vital Components Required for Testing and Operation - If your item(s) do not include a charger or battery vital component to operate your device(s) this may hold up the diagnosis process and payment period, up to five business days.

7. RETURNS - If we determine that you incorrectly submitted your electronic device, and the change in price is more than £25 or 25%, you will have the option of having your item(s) returned to you with costs liable to you. If you do not agree with our assessment of your electronic device, we will return your item to you. In the case of orders with multiple items, we will only return the items that have been re-priced. We will process and sell any items that match their quoted price (within a 25% price change range). Any item that matches the original quote (within 25% price change range) cannot be returned even though you may disagree with the re-price of other items included in your order. If you do not respond to any emails regarding the re-price of your items within five business days of receipt of your item(s), your item(s) will be processed at the new price based on the condition we receive your item in. PLEASE NOTE IF YOU ITEM DOES NOT HAVE VALUE AND YOU DO NOT REPLY TO OUR RE-PRICE EMAIL WITHIN FIVE BUSINESS DAYS YOUR ITEM(S) WILL BE RECYCLED. We remove protective layers and/or casing to check condition of your said item(s). If you want your item back for any reason, we are not responsible for any external shells, casings or protective layers on your item(s). DinerOmob will also have no liability on the cost of transit to get the product back to you.

A. Abuse of System - We understand that it can be difficult at times to determine the condition, type, or model number of an item and do not want to penalise our customers for errors in submission. However, we expect honesty and accuracy in how our customers submit their items. DinerOmob.com reserves the right at all times to determine whether or not abuse to our system and services has been made for any reason. We will not allow for clear and obvious errors in submission to happen without consequence. If we determine an abuse to our system has occurred, we will not provide free return shipping if it is requested via feedback. Any customer whose order has been deemed as abuse will be responsible for the cost of having their item returned to them. As with all orders, only those items that have an error in submission will be eligible to be returned. Abuse of our system may include, but is not limited to: a significant change in the condition of an item, submitting an item as a clearly different model, or submitting an item as a working item when it is clearly broken.


In the event of a package being damaged or lost in transit, DinerOmob.com will work to the best of our abilities with you to find a suitable solution.

A. Incoming Mail - If the respective package is never scanned in as received by the respective carrier, we are not responsible for that item if it does not make it to us. Furthermore, if that item is packaged insufficiently and is damaged in transit, we will not be responsible for that item. Using an unpadded, unsealed box or envelope, or using insufficient padding to send your electronic item(s) in to our facility is risky and not recommended. The value of any item inside an insufficiently packaged item will not be reimbursed. If you are unsure how to properly package an item, please take your item to a shipping store for assistance.

B. Outgoing Mail - We insure outgoing packages for the amount that we find the item to be valued at. If an item is re-priced due to an error in submission on the client’s part and the re-price exceeds 25%, we will happily return the said item if the re-price is not agreed upon. When we return an item, we will only insure said item at the value that we find it to be in, not the claimed condition and value. For example, if an item is submitted as “Flawless” and we find it to be water damaged, we will only insure the package for the water damaged value, not the “Flawless” value. The cost of returning the item will be charged to the User or sender.


By submitting your electronic device to DinerOmob.com you are representing that you are 18 years or older; you are the owner of the electronic device and no other individual or organisation has any rights, interest or ownership of this electronic device; you have the legal right to transfer ownership of the electronic device to us, without and clear of any encumbrances or liens; and this electronic device is not stolen.

A. Stolen, Fake and Counterfeit Item - Fake, stolen or counterfeit items will be turned over to the authorities upon receipt; we have a zero tolerance policy for fake or counterfeit items. All items that we find to be stolen or counterfeit will not be sent back to you. It is against the law to send these items through USPS as sending these items constitutes as mail fraud. We feel strongly that rewarding dishonest activities such as theft and counterfeiting is wrong. Stolen items will be immediately destroyed and recycled. 10. Unclaimed items/incorrect return information

If your item(s) arrive to us without proper contact information, a packing receipt or return labels, we will keep track of their receipt and itemise your item(s) at the prices found on our website at the time of receipt. If your items are re-priced, we will pay you the re-priced amount, if we are able to match them up to their said owner. Any re-pricing of items received without proper return information are final and you will be paid the new amount if we are able to match your information with you. Please make sure you have proper return / contact information on your package. There are no exceptions.

11. Price offer / Length of validity

 All prices quoted through DinerOmob.com or through email are valid for 21 days from the original submission or original email quote date. If we receive your item more than 21 days from the date of the original quote, your gadget (s) will be re-priced at the current pricing found by DinerOmob.com agents.

12. Warranty, Liability, Indemnification

DinerOmob makes no guarantee regarding the availability and performance of its Website. We therefore require all users to acknowledge that any use of www.dineromob.comand reliance upon any content shall be at your sole risk. Please also note that DinerOmob shall not be liable for any loss of data, lost profits or any other damages or losses resulting from such use.

The materials on www.dineromob.comare provided on “as is” basis and will be altered as required and as available, without any warranty or reprentation of any kind, whther express, implied, statuatory or otherwise. DinerOmob disclaims any and all warranties express of implied, including without limitation warranties of merchantability, accuracy, fitness for a particular purpose, non-infringement and the implied conditions of satisfactory quality and acceptance as well as any local jurisdictional analogues to the above and other implied or statuatory warranties.



13. Indemnity

You agree to indemnify, defend, and hold harmless DinerOmob, its parent, subsidiaries, affiliates, officers, directors, employees, agents, representatives, vendors and distributors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from your (or anyone using your account’s) violation or breach of any representation or obligation under these Site Terms. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you and, in such case, you agree to cooperate with our defense of such claim.

14. Electronic Notices and Transactions

You agree to transact with us electronically. This means you agree to accept and terms and conditions and to transact any sale, donation or recycling of your Product with us by electronic means. You authorise us to send you important notices about the Website and any pending transactions to an email address you provide to us, if you are a registered account holder or, in the alternative, by posting a notice on the Website. It is your duty to keep your email address up to date and to maintain a valid email address and to ensure that emails we send you are not filtered or stopped by spam filters or other types of email blocking functionalities. If you no longer desire to transact electronically with us, you may no longer use the Website.

15. Access

You are responsible for obtaining at your own expense all equipment and services needed to access and use the Website, including all devices, Internet browsers and Internet access. If you access the Website or a Website application through a mobile or wireless device, you are responsible for all fees that your carrier may charge you for data, text messaging and other wireless access or communications services.

DinerOmob makes every effort to ensure the information in, on or through its Website is accurate, however, because of the nature of information updates DinerOmob makes no guarantee as to providing accurate information always.


17. Notifications

 If you believe there has been any unauthorised use, whether the posting of unauthorised content, the establishing of an unauthorised Page, or a Page in violation of these terms, you should notify DinerOmob immediately by emailing info@dineromob.com

18. Miscellaneous

DinerOmob reserves the right to investigate complaints or reported violations of the Site Terms and to take any action DinerOmob deems appropriate including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to user profiles, e-mail addresses, usage history, posted materials, IP addresses and traffic information. DinerOmob reserves the right to seek all remedies available at law and in equity for violations of these Site Terms, including but not limited to the right to block access from a particular Internet address to any Second Rotation website. These incorporate by reference any notices contained on the Website and constitutes the entire agreement with respect to access to and use of the Website. If any provision of these Site Terms is unlawful, void or unenforceable then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.
